GrowMindGrow Terms of Service

These Terms are the agreement between you and GrowMindGrow. They cover who may open an account, what a family or a school gets, what we each owe the other, and what happens when somebody wants to stop. We have written them to be read, because an agreement nobody can read protects nobody.

Two things are worth saying before the detail. GrowMindGrow is a service for children, and we do not advertise to them. We do not sell or rent personal information, we do not serve advertising anywhere in the product, and we do not let anyone else do either. And what you and your child create stays yours; the limited permission you give us in section 7 exists only so that we can run the service, and it ends when you delete the material.

How children's personal information is handled is set out in our Privacy Policy, which forms part of this agreement. If these Terms and the Privacy Policy ever disagree about children's information, the Privacy Policy governs.

1. Who We Are and What This Covers:

GrowMindGrow provides adaptive learning games and progress reporting for children in preschool through grade 5, together with the websites, applications and features that deliver them (the “Service”). This includes our marketing site, the parent and school portals, and the play site at play.growmindgrow.com.

By creating an account or using the Service you accept these Terms. If you do not accept them, please do not use the Service.

We may update these Terms; section 14 explains how, and how you will be told.

2. Accounts:

There are three kinds of account, and they are not interchangeable.

  • A parent or guardian account. Held by an adult, who adds and manages child profiles under it. You must be 18 or older and able to enter into this agreement.
  • A child profile. Created by a parent or by a school, never by the child. A child signs in with their own credentials, but the profile belongs to, and is controlled by, the adult who created it.
  • A school account. Held by a school or education organization and covered by section 4.

You are responsible for keeping account credentials secure, for what happens under your account, and for the accuracy of what you tell us. Tell us promptly at hello@growmindgrow.com if you believe an account has been used without permission.

3. Children:

A child under 13 cannot enter into this agreement, and we do not ask them to. The agreement is with the adult — the parent or guardian who created the profile, or the school that enrolled the pupil — and that adult is responsible for the child's use of the Service.

If you create a profile for a child, you confirm that you are their parent or legal guardian, or that you are authorized by the school to act for them under section 4.

A parent or guardian may at any time review what we hold about their child, correct it, delete it, or tell us to stop collecting anything further. Where a school holds the child's record, deletion is requested through the school, which we pass on and the school acts on. The Privacy Policy sets out exactly how each of these works and where in the product to do it.

Children cannot send or receive messages on GrowMindGrow, cannot upload files, and cannot see or contact other children. There is no public or child-to-child communication feature of any kind.

4. School and Educator Accounts:

If you open an account for a school, district, or other education organization (an “Education Organization”), then “you” in these Terms means both you and that organization, and you confirm that you are authorized to accept these Terms on its behalf.

An Education Organization may enrol pupils and invite parents and staff to link to its account, provided it already has a genuine relationship with those people outside GrowMindGrow, such as the relationship between a school and its pupils. You agree not to use the Service to contact anyone you do not already have such a relationship with, and not to use it to advertise anything.

Where a school provides pupil information to us, the school directs how that information is used, and we act on its instructions. We use it only to provide the Service to that school and for the educational purpose it was given to us for. We do not use pupil information for any commercial purpose of our own, we do not sell it, and we do not use it to build advertising or marketing profiles. We make ourselves available to schools as a school official with a legitimate educational interest in the pupil records we are given, and we will follow the school's reasonable instructions to correct or delete them.

A school that needs a separate written data protection agreement should contact us at mydata@growmindgrow.com.

Sections 11 and 12 apply to Education Organizations only so far as the law permits. Where a public body cannot lawfully give an indemnity or accept a limitation of liability, we do not ask it to.

5. Free and Premium:

The free tier of the Service does not expire and does not require a card. Your child can play the core games for as long as you like without paying anything.

Premium is a paid subscription that adds the rest of the game library and the progress reporting that reads it. If you subscribe:

  • You are charged in advance for each period, and the subscription renews automatically at the end of each period until you cancel it.
  • Payment is taken by our payment processor. We do not store your full card details.
  • You can cancel at any time from the Billing page in your account, without contacting us and without explaining why. Cancelling stops the next charge.
  • Cancelling does not refund the part of the period already paid for, and we do not otherwise offer refunds except where the law requires one.
  • When a subscription ends your account stays open on the free tier. Every child keeps their profile and everything they have done.

We may change our prices or what each tier includes. If a change affects what you are already paying for, we will tell you before it takes effect, and you can cancel if you do not want to continue.

6. Acceptable Use:

Please use the Service for what it is for. You agree not to:

  • copy, resell, redistribute or publish the games, questions, artwork or reporting, or use them for anything other than your own family's or your own school's use;
  • reverse-engineer, decompile or attempt to extract the source of the Service, except so far as the law allows despite this restriction;
  • interfere with the Service, probe or test its security, or try to reach accounts, records or data that are not yours;
  • use automated means to scrape or bulk-download content, or place unreasonable load on the Service;
  • upload anything unlawful, or anything that infringes somebody else's rights;
  • use the Service to contact anyone you do not already have a relationship with, or to advertise; or
  • misrepresent who you are, or claim an authority over a child that you do not have.

If somebody is misusing the Service, or you believe content on it infringes your rights, tell us at legal@growmindgrow.com and we will look into it.

7. Content:

Ours:

The games, questions, artwork, text, reporting and software that make up the Service belong to GrowMindGrow or to those who license it to us. We give you permission to use them for your own family's or school's use while your account is open. That permission does not transfer any ownership to you, and it does not include our name or logo.

Yours:

Some parts of the Service let an adult create material — a teacher writing an assignment, a school posting to a newsfeed, notes recorded against a pupil, messages between staff and parents. That material stays yours.

So that we can actually run the Service, you give us permission to store it, display it to the people you intended it for, and process it as the Service requires. That permission is limited to operating the Service, it is not transferable to anyone else for their own purposes, and it ends when you delete the material or close the account. We do not publish it, license it onward, or use it to promote GrowMindGrow.

You are responsible for material you create: that you have the right to post it, and that it is lawful. We may remove material that breaks these Terms or the law.

If you send us feedback or a suggestion about the Service, we may act on it without owing you anything for it. That is the only thing in this section we ask to keep.

8. Privacy:

Our Privacy Policy explains what we collect, why, who we share it with, how long we keep it, and how you exercise your rights — including the rights a parent has over a child's information. It forms part of this agreement, and it is worth reading properly rather than accepting.

9. Availability, Changes and Support:

We work to keep the Service running, but we do not promise it will be uninterrupted or error-free. Maintenance, faults and changes in the law can all interrupt it.

We may change, add or withdraw features. If we permanently withdraw something you have already paid for, we will refund the unused part of what you paid for it.

10. Ending the Agreement:

You can stop using the Service at any time. To cancel a subscription, use the Billing page in your account. To close an account and delete the personal information in it, follow the steps in the Privacy Policy or write to mydata@growmindgrow.com.

We may suspend or close an account that is breaking these Terms, being used to harm someone, or being used unlawfully. Except where the problem is serious or urgent, we will tell you first and give you a chance to put it right. If we close a paid account without good reason, we will refund the unused part of the period.

Sections 6, 7, 11, 12, 13 and 15 continue to apply after this agreement ends, so far as they need to.

11. Disclaimers:

We provide the Service with reasonable care and skill. Beyond that, and so far as the law allows, the Service is provided as it is: we do not promise that it will meet every requirement, that it will be available at any particular moment, or that it will produce any particular educational result. Progress reporting is a tool to help an adult decide what to do next, not an assessment, a diagnosis, or a substitute for a teacher's or a clinician's judgement.

12. Our Responsibility to You:

Nothing in these Terms limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited.

Otherwise, and so far as the law allows: we are not liable for indirect or consequential loss, or for loss of profit, business or data; and our total liability arising out of the Service in any twelve-month period is limited to the amount you paid us in that period, or one hundred United States dollars if you paid us nothing.

13. Your Responsibility to Us:

If somebody brings a claim against us because of something you did that broke these Terms or the law — material you posted that you had no right to post, or use of the Service that harmed someone — you agree to cover the reasonable costs of that claim. This does not apply to an Education Organization to the extent it cannot lawfully give such an undertaking, and it does not apply to anything that was our fault.

14. Changes to These Terms:

We may update these Terms. When a change is material we will tell you before it takes effect, by email or by a notice in the Service, and we will change the “last revised” date at the top. If you do not want to continue under the new Terms, you can cancel or close your account.

15. Law and Disputes:

These Terms are governed by the laws of the State of Texas, United States of America, and the courts of the State of Texas have jurisdiction over any dispute arising out of them.

If something has gone wrong, please write to us first at legal@growmindgrow.com. Most problems are quicker to fix that way than through a court, and we would rather fix them.

Nothing in this section removes a right you have under the consumer law of the place you live, including any right to bring a claim there.

16. General:

These Terms, together with the Privacy Policy and any additional terms you separately agree to, are the whole agreement between us about the Service. If any part of them is found unenforceable, the rest continues to apply. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your rights under these Terms without our agreement; we may transfer ours if our business is sold or reorganised, and your rights are not reduced if we do.
